An award winning chef allegedly raped a sleeping young woman after a Champagne party to celebrate him taking over the tenancy of a top Devon pub.
Daniel Botterill took a photo of the semi naked teenager after having sex with her in a guest bedroom at the Yarcombe Inn at Yarcombe where he had just become the landlord.
The girl says she had gone asleep alone but woken up to find her lower clothes ripped off and 37-year-old Botterill in bed with her.
He was egged on by has assistant chef who had sent him a text earlier saying the girl wanted to sleep with him, Exeter Crown Court was told.
Botterill, of Yarcombe, near Honiton, denies raping the woman 11 days before Christmas in 2012. He says they went to bed together and was a willing partner in sex.
Miss Mary McCarthy, prosecuting, said Botterill had been drinking to celebrate his promotion to landlord at the Yarcombe Inn, and joined the girl, a female friend of hers and his chef Darren Billingham at another pub.
He went home but Mr Billingham sent him a text saying the woman wanted to have sex with him and they all ended up going back to his pub in the early hours to drink champagne and have something to eat.
The other woman fell asleep by the fire and the alleged victim also decided to go to bed and went to one of the rooms normally rented out to guests.
Miss McCarthy said:”The last thing she can remember before any sexual activity took place is getting into bed still dressed in black jeans and top with the handle of her bag still over her shoulder.
“She went to sleep and she says she woke to find the defendant with her and that she was no longer wearing her trousers or underwear. He was performing oral sex on her.
“She was shocked and did not know what to do. Although she says no he continues and has sex with her. There was full sex without her consent.
“Soon after the activity finished she was lying there in a doze and remembers Mr Billingham coming in and saying words to the effect of ‘good on you’ to the defendant.
“She also recalls the defendant pulling over the covers to reveal her naked lower half and taking a picture of her on his mobile phone.
“The Crown’s case is that he was heavily in drink and came to expect sex with the complainant, no doubt egged on by the rather crude text he received from his chef Mr Billingham.
“She went upstairs to sleep and he went upstairs for sex. He found her asleep and helped himself and took the photo because he was not in a fit state to know what he was doing.
“It is exactly the sort of thing that an offender who is disinhibited by drink when he sexually assaults someone who they thought was asleep or incapable through drink.”
Miss McCarthy said the woman waited for him to go to sleep then went downstairs to wake her friend and they went together to a friend’s house nearby at 5 am where they called the police.
She said Botterill told police she had agreed to sex and he had taken the picture afterwards to show people in the pub.
