Exeter City fan Ricky Pengelly released from prison after appeal against "smoke grenade" sentence

AN Exeter City fan who was sent to prison for trying to take a smoke grenade to a match between the Grecians and Torquay has been freed after an appeal.

Ricky Pengelly, 18, of Exeter, was jailed for two months and given a six-year football banning order at South Devon Magistrates court last month. He was stopped while attempting to enter Plainmoor at the Torquay United v Exeter City match on January 15, then detained at Torquay Custody Centre before being charged with an offence under the Sporting Events Act 1985.

But he appeared at Exeter Crown Court this week and was successful in an appeal against the severity of his sentence. He is now the subject of a community order, with a requirement that he will have to complete 100 hours of unpaid work within the next 12 months, and the banning order was reduced to three years.
